♦ During the first contact following receipt of the form, Nelkah will send you a contract to be signed by both parties.
♦ By accepting a commission and making a payment, you ("the commissioner") agree to be bound by the following terms of service ("agreement") between you and Nelkah ("the artist").
♦ Commissioner and artist may not share each other's personal contact details with third parties.
Please read this agreement carefully before proceeding with your order.
• The Artist will keep the Commissioner updated with screenshots of the progress until completion.

G e n e r a l
• The Artist reserves the right to decline any orders without detailed explanation.
• The purchase is for digital files only. No physical copies will be provided or shipped.

♦ The artist will contact the commissioner when ready to begin the artwork.
♦ Payment upfront. After notifying the start of work, payment is made after receiving a first quick sketch. But it still upfront. Until payment is made, the drawing stagnates.
Commission form -> Starting alert -> Quick sketch -> Payment -> Working on the art.

♦ If the drawing is to be used in a commercial purpose or environnement, I (the artist) ought to be notified. Otherwise i would consider this a violation of the T.OS, therefore a violation of the contract.
♦ The purchase is for digital artwork (not any sort of physical material).
Confidentiality and Acceptance
♦ Private artwork or withholding me from posting the final piece at all may cost extra.
♦ Commissioner cannot post the full size drawing publicly.
♦ I may post the finished artwork and the WIPs. The client can request to keep the drawing hidden until the end of the project if it is a commercial or event drawing only.
♦ The drawing may or may not be used in a speedpaint video. You cannot request this or pay for it because I cannot assure that there will be one.
♦ The purchase is for digital artwork (not any sort of physical material).

Usage and credits: Commercial Usage
​
♦ 1x price, not for commercial use (avatar usage in non-profitable social media is fine)
♦ 1.5x price, you can use in monetized platforms such as twitch.tv and YouTube, please remember to credit me.
♦ 2x price, you can use in monetized platforms and sell merchandise of it, this pricing is for small business only.
♦ 3x price, this is for big business or expected high selling products.
Please keep in mind that those are indicative multipliers, every case is different and thus multipliers may vary.
Completation Time & Deadlines
♦ No deadlines. Due dates can be manage only months in advance.
♦ Due to backlog/schedule, faster completion or deadlines may require extra fees.
♦ A project that is too tight could be refused or reduced in terms of quality.
♦ If your order is complex and taking a long time, I might be working on something else in parallel to unzip. Or just keep paying my bills actually...

Process
♦ Please ensure the initial description is accurate if you want something to impose and in any case, please pay attention to the preview and draft as it is the proper stage for modifications.
♦ Commissioner can request "Work in Progress" (WIP) screenshots at any part of the process.
♦ If you order more than one characters on separate drawing, consider that only the first one will be priorities.
♦ Only commercial purpose illustration can have more than three character on the same drawing.

• R e v i s i o n s •
​
♦ Once the draft is valided, small changes like color adjustments / adding small details (or fixing mistakes) could be done for free.
♦ However, any large changes (e.g., clothing changes, pose, setting, light) will be charged extra.​
♦ After the delivery and validation no changes.

Delivery & Usage
♦ When the drawing is validated by you, it is considered finished. Any retouching after final validation of the final illustration is considered new work. Any change after delivery incurs additional costs.

♦ Large and resized versions of the artwork are provided once completed.
♦ Public posting of large version is prohibited to prevent theft and redistribution.
♦ All forms of reposts online must be credited, with the inclusion of link/mention to my social media.
♦ Reposting other commissioner's artwork is prohibited.
♦ Overlays and PSD files are included for copyright orders only. (Vtuber, Twitch waiting for animated screen, etc.).​​​​​​
Refunds
♦ Refunds are not offered.
♦ The only case, is if I can't do it. (Physical accident, health issues.)
♦ I will adapt your character to my style, not the other way around. If the style does not match your character (in your eye), you should have been more careful.
Important information
♦ Because of my fragile and quite unstable health due to my illness, I will not be able to do more than draw at my own pace. By taking an order from me, I therefore believe that you have read and accept the conditions that go with it, while certifying you that your order will be finalized. No pressure will be accepted from individuals and exclusive events.

Usage and credits: Personal Usage
♦ Nelkah retains all rights, including intellectual property rights, to the commissioned artwork. Nelkah has the right to use, display, and reproduce the artwork for promotional or commercial purposes, including but not limited to, prints, merchandise, and online portfolios.
♦ The Commissioner may not claim ownership or authorship of the artwork.
♦ If not agreed upon, the artwork is for personal use only. The Commissioner may not reproduce, distribute, or use the artwork for commercial purposes without the express written consent of the Nelkah or pay extra costs.
• The Commissioner may post on social media platforms providing credits to the Artist.
• If the Commissioner requests private artwork or wishes to withhold the artist from posting publicly, additional charges may apply. The details and fees for private artwork will be discussed and agreed upon separately.
• The Artist may choose to create a speedpaint video featuring the commissioned artwork. However, the inclusion of the artwork in a speedpaint video is at the discretion of the Artist and cannot be guaranteed.
